CLIENT: THE TENANT
HAPPYHOST: “HappyHost” refers to any natural or legal person who, under agreement with HappyRide PR, Car Rental, provides one or more vehicles of their own to be managed, promoted, and rented by the company to third parties, in exchange for an agreed-upon financial compensation. HappyHost retains ownership of the vehicle, while HappyRide PR handles operational administration, customer service, marketing, reservations, and rental-related processes.
Between: HAPPYRIDE PR LLC, a company organized under the laws of the Commonwealth of Puerto Rico, hereinafter “THE LESSOR”, and the client who signs at the end, hereinafter “THE LESSEE”, both parties agree to the following:
HAPPYRIDE PR LLC (“HAPPYRIDE PR,” “we,” or “us”) offers an online vehicle rental platform that connects vehicle owners with travelers and local residents looking to book their vehicles. HAPPYRIDE PR’s vehicle platform is available online. HAPPYRIDE PR’s website, blog, associated applications, and associated services are collectively referred to as the “Services.” By accessing or using the Services, including communicating with us, you agree to comply with and be legally bound by the provisions of these Terms of Service (these “Terms”), regardless of whether you register as a user of the Services. These Terms govern your access to and use of the Services and constitute a binding legal agreement between you and Happyride PR LLC.
These Terms, together with the Cancellation Policy , Non-Discrimination Policy , applicable insurance terms and certificates, roadside assistance terms, and additional policies (collectively, the "Policies") constitute the "Agreement" between you and Happyride PR (each a "Party" and together, "the Parties"). In addition, Happyride PR provides a Vehicle Use Agreement summarizing the terms of each reservation agreed upon between HAPPYHOST and RENTER at the time of booking and any modifications, accessible on the Services for any booked or prior ride and which you can use as proof of a reservation. HAPPYRIDE PR acts as an intermediary for transactions between the Renter who reserves a vehicle on the Services and the vehicle owner or HAPPYHOST affiliate that lists a vehicle for booking on the Services ("HAPPYHOST").
PURPOSE OF THE CONTRACT
By means of this contract, THE LESSOR leases to the LESSEE the vehicle described in the reservation sheet and/or invoice, subject to the terms and conditions agreed herein.
CONTRACT DURATION AND RETURN POLICY
This rental will be for a specific period, based on the dates and times expressly indicated on the reservation form and/or invoice issued by HAPPYRIDE PR LLC. The vehicle must be returned and picked up strictly within this period.
Grace Period: The LESSOR grants the LESSEE a grace period after the agreed time for the return of the vehicle, during which no additional charges will be applied, depending on the type of unit rented, as follows:
Slingshot Vehicle: A thirty (30) minute grace period is granted. After this period, a charge of one hundred dollars ($100.00 USD) will be applied for each additional hour or fraction of an hour of delay.
Jeep and Van Type Vehicles: A one (1) hour grace period is granted. After this period, a charge of fifty dollars ($50.00 USD) will be applied for each additional hour or fraction of an hour of delay.
Delays: If the vehicle is returned after the applicable grace period, the LESSEE will incur the aforementioned charge according to the type of vehicle. Once the maximum established delay limit has elapsed, without the vehicle having been returned, it will be understood that the LESSEE has unilaterally extended the contract for an additional period of one (1) full day, applying the current daily rate corresponding to the rented vehicle, without prejudice to other charges, penalties or legal actions that may arise from said non-compliance.
The LESSEE acknowledges and agrees that any extension of the rental period will be strictly subject to the availability of the unit and express approval by HAPPYRIDE PR LLC.
VERIFICATION
Where permitted, HAPPYRIDE PR has the right, but not the obligation, to conduct screenings, checks, and participate in processes designed to help verify the identities or background checks of users, including driving history and driver's license validity. HAPPYRIDE PR may allow or deny your request to reserve or list a vehicle at its sole and absolute discretion.
SECURITY DEPOSIT
The Lessee will provide a specified security deposit for each vehicle, which may be used by the Lessor to cover damages, fines, towing, administrative fees, or any breach of contract. If no damage is reported, the deposit will be refunded within a maximum of 7 business days after the vehicle is returned and inspected.
PAYMENT AND DEPOSIT CONDITIONS
The TENANT may pay for the reservation using a credit or debit card, provided that it is issued by an authorized financial institution and is in the name of the reservation holder.
In the event that payment is made by debit card, the LESSEE agrees that a mandatory security deposit of five hundred dollars ($500.00 USD) will be required, which will be temporarily held during the rental period and will be released, partially or totally, once the vehicle has been inspected and its return in optimal conditions confirmed, in accordance with the clauses of this contract.
The deposit may be used by HAPPYRIDE PR LLC to cover any damages, penalties, additional charges, special cleaning, excess mileage, refueling, fines, or any other obligations incurred by the LESSEE under this contract.
American Express cards are not accepted as a payment method for any transaction, whether for the reservation, final payment, or deposit. It is the RENTEE'S responsibility to ensure they have a valid and accepted payment method at the time of booking.
Fee
The fees we charge for using the Services and other cost structures will be detailed for renters at checkout. You can check your trip amount at checkout before submitting your trip request.
When you provide HAPPYRIDE PR with a payment method, you authorize HAPPYRIDE PR LLC, or third-party service providers acting on HAPPYRIDE PR's behalf, to store your payment credentials for future use in the event that you owe HAPPYRIDE PR money. You authorize HAPPYRIDE PR to use the stored payment credentials for balances including trip costs, insurance, cleaning, fuel, among others, and Renter fees (for example, late fees, security deposits, processing fees and claims costs, and related administrative fees). In some cases, our payment processors have agreements with the card networks to automatically update the stored payment credentials each time you receive a new card (for example, replacing an expired card or one that was reported lost or stolen), and we will rely on those updates to the stored payment credentials for balances. If we attempt to issue a refund and the original payment method is no longer registered or cannot be accessed, we reserve the right to issue travel credit instead of a refund to your original payment method.
Collection of fees
HAPPYRIDE PR and its service providers will employ all available legal means to collect amounts owed, including the engagement of collection agencies or legal counsel. In addition to the amount owed, delinquent accounts or chargebacks will be subject to fees incidental to the collection of delinquent accounts or chargebacks, including, but not limited to, collection fees, convenience fees, and other third-party fees.
CARD CHARGE AUTHORIZATION
The RENTER authorizes HAPPYRIDE PR LLC to automatically charge his or her card for damages, fines, cleaning, fuel, or any breach of contract.
CANCELLATION POLICY
If the Lessee cancels the reservation with less than 24 hours' notice, the Lessor will retain 50% of the total deposit as administrative and opportunity costs. If the cancellation is made more than 24 hours before vehicle pickup, the cancellation will be penalty-free, and 100% of the deposit will be refunded.
DISTANCE AND USE LIMIT
The Lessee agrees not to drive the vehicle outside of Puerto Rico. Furthermore, driving at a speed greater than that permitted by the Puerto Rico Traffic Law (Act No. 22-2000) is prohibited.
Legal Maximum Speed Limits (Act No. 22-2000): The limits established below and in the manner hereinafter authorized shall be the legal maximum speed limits and no person shall drive a motor vehicle upon any public highway at a speed greater than such maximum speed limits: (a) Twenty-five (25) miles per hour in urban areas, except on highways with a total of four or more lanes, where the Secretary may establish a maximum of thirty-five (35) miles per hour. (b) Forty-five (45) miles per hour in rural areas, except on those highways where the Secretary determines that the maximum speed shall be up to fifty-five (55) miles per hour. (c) Twenty-five (25) miles per hour in a school zone, as identified by the appropriate authority, from 6:00 AM to 6:00 PM during school days or other hours or periods as may be designated or identified by fixed message signs, variable message signs, flashing yellow traffic signals, or other traffic control devices, or a combination thereof. (d) Any motor vehicle transporting toxic materials or hazardous substances shall not exceed thirty (30) miles per hour in rural areas and fifteen (15) miles per hour in urban areas. In determining what constitutes toxic materials or hazardous substances, the definition established for such purposes in regulations adopted by the Commission pursuant to the authority granted to it by Act No. 109 of June 28, 1962, as amended, or any statute subsequently governing such matter shall be followed. (e) The speed on highways shall be sixty-five (65) miles per hour in areas where the current criteria of the American Association of State Transportation Officials (AASHTO) are met.
TENANT'S OBLIGATIONS
As a Renter, you agree to drive legally and to provide HAPPYRIDE PR or through the Services with proof of your valid driver's license. You will treat the vehicle and any applicable Extras appropriately and take all reasonable steps to return it on time and in substantially the same condition as you received it. You will not allow anyone other than the person(s) named in the reservation and trip details as the Authorized Driver(s) to drive the vehicle you have reserved.
Prohibited activities
In connection with your use of or access to the Services, you agree that you will not, on your own behalf, nor advocate, encourage, solicit, or assist any third party to:
Violate any law, including:
Providing or sending any false or misleading information, including:
Failure to fulfill its commitments, including:
USE OF PROTECTIVE HELMET IN SLINGSHOT VEHICLE
HAPPYRIDE PR LLC strongly encourages the LESSEE and any authorized passenger to wear a protective helmet at all times while driving or riding as an occupant of the Slingshot type vehicle, for the sake of physical safety and in accordance with the best responsible driving practices.
As part of the service, two (2) protective helmets are delivered with the vehicle, at no additional cost, which must be used properly and returned in the same condition in which they were delivered.
The RENTER accepts and acknowledges responsibility for the helmets delivered. In the event of loss, damage, or non-return of any helmet, HAPPYRIDE PR LLC reserves the right to automatically charge one hundred dollars ($100.00 USD) for each helmet, using the payment card registered by the RENTER.
This provision forms an integral part of the lease agreement, and failure to comply with it may result in contractual consequences as stipulated herein.
USAGE POLICY – PROHIBITION OF SMOKING AND TRANSPORTATION OF PETS
Smoking ban:
Smoking or permitting smoking inside the rented vehicle, whether tobacco, e-cigarettes, marijuana, cigars, pipes, or any other similar product, is expressly prohibited. This provision applies to both the LESSEE and any companion or third party using the vehicle during the rental period.
If evidence of smoke, residue, a persistent odor, or damage related to the use of smoking products is detected, the RENTER authorizes HAPPYRIDE PR LLC to automatically charge the credit card on file for a deep cleaning and professional deodorization of the vehicle. This charge is non-negotiable and non-refundable.
Pet Transport:
HAPPYRIDE PR LLC declares itself a Pet Friendly company, therefore, pets are permitted to be transported in its vehicles, provided the following conditions are met:
The LESSEE assumes full responsibility for any damage, dirt, or deterioration that the pet causes to the interior or exterior of the vehicle.
In the event that the vehicle requires additional or specialized cleaning as a result of transporting the pet (hair, odors, stains, fluids or other residues), the LESSEE accepts and authorizes the charging of a fixed fee of fourteen dollars and ninety-nine cents ($14.99 USD).
The pet must be transported safely and in conditions that do not compromise the integrity of the vehicle or the safety of its passengers.
Failure to comply with this clause will entitle HAPPYRIDE PR LLC to make the corresponding charges without prior notice, using the payment method registered by the LESSEE, in accordance with the provisions of this contract.
Other legal matters
Violations. HAPPYRIDE PR has the right, but not the obligation, to investigate, prosecute, litigate, or refer violations of this Agreement to the fullest extent permitted by law.
SUPPLY OF A SET-UP TENT FOR SLINGSHOT VEHICLE PROTECTION
HAPPYRIDE PR LLC provides, at no additional cost, a portable, pop-up tent along with the Slingshot vehicle, so that the RENTER can cover the vehicle while it is parked, especially in case of rain or prolonged exposure to the sun.
It is the responsibility of the TENANT to use the tent properly and ensure that it is properly installed, stored, and returned at the end of the rental period.
In case of loss, damage or failure to return the pop-up tent, the LESSEE authorizes HAPPYRIDE PR LLC to make an additional charge of one hundred dollars ($100.00 USD) to the registered card, corresponding to the replacement of the supplied equipment.
This tent is considered part of the equipment temporarily delivered to the LESSEE along with the vehicle, and is subject to the same liability conditions applicable to the rest of the accessories included during the rental.
Communications with You. You agree that HAPPYRIDE PR may contact you by electronic means (e.g., email; messaging notifications, texts, calls) in lieu of any required mailed notices. To contact you more efficiently, you agree that we may also occasionally contact you via automated or prerecorded messaging calls or text messages to your phone number(s). We will not make such calls for marketing purposes. Instead, we may only make such calls or text messages to confirm your registration, provide notices about your reservation or service-related activities related to your reservation, investigate or prevent fraud, collect a debt owed to us or recover unpaid invoices, or communicate urgent messages. We may share your phone number(s) with service providers we contract with to assist us in pursuing these interests. We will not share your phone number(s) with third parties for their own purposes without your consent.
You authorize HAPPYRIDE PR and our service providers, without prior notice to you, to monitor or record telephone conversations or web chat interactions that you or anyone acting on your behalf have with HAPPYRIDE PR and its agents for quality assurance, training, or other purposes. You understand and agree that your communications with HAPPYRIDE PR may be overheard, monitored, or recorded. If you do not wish to have your call recorded, please contact us in writing at reservaciones@happyridepr.com. If you do not wish to have your chat activity recorded or monitored, please do not use the chat feature of the Services.
INSURANCE AND PROTECTION PLANS
HAPPYRIDE PR LLC declares, and the LESSEE acknowledges, that HAPPYRIDE PR is not an insurance company, nor does it act as such under the laws of the Commonwealth of Puerto Rico or any other jurisdiction. Consequently, HAPPYRIDE PR does not offer direct insurance coverage nor does it guarantee any coverage for the lessee or vehicle owners (hereinafter, "HAPPYHOST").
Insurance or protection plans offered through the HAPPYRIDE PR platform are provided exclusively by authorized third-party providers, independent of HAPPYRIDE PR, and are subject to their own terms, conditions, restrictions, and exclusions.
Access to these plans by HAPPYHOST and RENTERS is subject to full compliance with the terms and conditions of this agreement, as well as any additional policies published by HAPPYRIDE PR.
The LESSEE understands and accepts that:
The purchase of these protection plans is entirely voluntary and subject to availability.
The protection plans for HAPPYHOST and TENANTS are independent of each other and are not linked in scope, conditions, or coverage.
HAPPYRIDE PR assumes no responsibility for claims, compensation, claims processes, denials, partial payments, or any decisions made by the insurer or plan provider.
For more information and specific terms and conditions regarding the protection applicable to your status as a TENANT, please refer to the sections corresponding to each type of user, which form an integral part of this agreement. Specific terms and conditions for tenants.
HAPPYRIDE PR LLC offers the option of purchasing additional insurance, the acceptance or rejection of which will be confirmed by THE RENTER. Failure to purchase this insurance means THE RENTER agrees to assume all damages and costs that may arise during the rental period.
Lessee's financial responsibility for physical damage to the vehicle.
The Renter who booked the trip (the "Primary Renter") is financially responsible for any physical damage or theft of the reserved vehicle that occurs during the trip, as well as any additional costs and charges resulting from any damage to the vehicle, regardless of who is responsible. This responsibility applies regardless of whether the primary renter has their own auto insurance.
Primary renters may be insured against damage to the reserved vehicle under their own insurance policies. By reserving a vehicle with HAPPYRIDE PR, you agree that if the reserved vehicle sustains any damage during the trip, you will contact HAPPYRIDE PR to file a claim for coverage under any insurance policy applicable to the loss.
If the Renter has their own auto insurance policy, this will be the primary liability insurance or protection offered on each trip, depending on various factors, such as applicable law, the location where the Renter reserves the vehicle, or the location where the accident or damage occurred.
Use of the vehicle
When you book a vehicle on the Services, you must use it only for your personal or professional use and not for any commercial purposes.
You must present HAPPYRIDE PR with a current and valid driver's license. You must exercise reasonable care in your use of the vehicle. You must always operate the vehicle safely and in compliance with all applicable laws, including, but not limited to, speed limits and prohibitions against driving under the influence or while distracted. In the event HAPPYRIDE PR has any concerns about your use of a vehicle, HAPPYRIDE PR may cancel your trip at its discretion at any time and require the return of the vehicle, including repossessing it even on behalf of the HAPPYHOST. You must wear seat belts during vehicle operation and require all passengers to wear them. You must also comply with all laws or regulations related to child safety seats and other child protection. You must not leave the vehicle unlocked or with the keys loose (e.g., in the ignition). You must not engage in any prohibited use with any vehicle you book through the Services.
If you misuse a vehicle, you will be fully responsible for any related claims, losses, or damages, and your protection plan may be voided. Renters also acknowledge that using a vehicle in a prohibited manner or violating this Agreement may reduce available liability coverage to the minimum legal limits or void it, and may also void any comprehensive or collision coverage or any protection plan, to the extent permitted by applicable law.
Telematics Data Notice and Release. Vehicles booked on HAPPYRIDE PR may have features or an onboard device that monitor their condition at all times during the trip. Non-personal information collected by these features or the onboard device may include, for example, vehicle status; damage and accident records; performance, operational, and diagnostic data; and information regarding mileage, acceleration, speed, fuel consumption, fuel level, tire pressure, odometer, location and direction, and other vehicle information ("Vehicle Data"). Use of these features or the onboard device is subject to the terms and conditions published by the vehicle manufacturer or technology provider, which may include system and service limitations, warranty exclusions, limitations of liability, wireless service provider terms, privacy practices, descriptions of information use and sharing, and user responsibilities. Except as prohibited by law, you authorize the use, disclosure, or access to Vehicle Data and must inform any Authorized Driver and passengers of the terms of this section. You release HAPPYRIDE PR and its affiliates through HAPPYHOST and agree to indemnify, defend, and hold harmless HAPPYRIDE PR and its affiliates through the HAPPYHOST section, the operator of the integrated features or devices, wireless carriers, and other component or service providers, and their respective employees, officers, directors, and agents from any damages (including incidental and/or consequential damages) to persons (including, but not limited to, you, an Approved Driver, and passengers) or property caused by the failure of the features or integrated device to function properly or otherwise arising from the use of the feature or integrated device by you, an Approved Driver, or passengers.
GPS TRACKING SYSTEM NOTIFICATION AND ACCEPTANCE. The LESSEE acknowledges and agrees that the rented vehicle is equipped with a GPS tracking system installed by HAPPYRIDE PR for the purpose of ensuring security and compliance with the contract, facilitating location in the event of an emergency, and ensuring compliance with the terms of this contract.
This system is NOT optional and may NOT be deactivated or removed by the LESSEE, or any other person not authorized by HAPPYRIDE PR. Any attempt to tamper with, deactivate, or remove the GPS device will constitute a serious violation of this contract, authorizing HAPPYRIDE PR to take appropriate legal action, including, but not limited to, immediate termination of the contract and repossession of the vehicle. In addition, the LESSEE will be responsible for any damages or associated costs resulting from such tampering or removal.
The LESSEE understands that, pursuant to Traffic Law No. 22-2000 and the Civil Code of Puerto Rico, such conduct may be considered a breach of contract or even fraud. Under applicable laws in Puerto Rico, the removal or tampering with a GPS device legitimately installed by the vehicle owner may be considered a breach of contract and may result in additional legal penalties.
By signing this contract, the LESSEE confirms that he or she has been duly notified of the presence of the GPS system in the vehicle, understands its purpose, and agrees to comply with the conditions set forth herein.
Vehicle Condition and Optional Extras
You understand that HAPPYRIDE PR LLC and third parties own the vehicles and Extras offered through the Services. Each owner is responsible for complying with all legal requirements (including ensuring the vehicle is registered and insured) and for maintaining their vehicle(s) in safe and roadworthy condition. Please complete a visual inspection before beginning use of the vehicle. If you find damage during your initial inspection, you must submit photos of such pre-existing damage at the beginning of your reservation to the following email address reservaciones@happyridepr.com, including your reservation details, to ensure that we are not liable for pre-existing damage. If you find damage during your initial inspection and do not report it, HAPPYRIDE PR, third-party administrators, or insurance partners may assume that the damage occurred during your reservation period. If, after your initial inspection, you believe the vehicle is not safe to drive, please do not use the vehicle; Instead, please contact the HAPPYRIDE PR team immediately at +1 (787) 905-1822.
We are not responsible for shared vehicles or personal belongings. You also acknowledge and agree that neither HAPPYRIDE PR nor HAPPYHOST are responsible for lost or stolen property left in any vehicle or taken or damaged during a trip.
Incident report
If you chose a protection plan when booking your trip through the Services, you must immediately inform HAPPYRIDE PR of any damage to the vehicle you are using at reservaciones@happyridepr.com or +1 (787)905-1822.
You must make every reasonable effort to obtain evidence from any available witnesses and provide HAPPYRIDE PR or the third-party claims administrators with a written description of the incident and any other requested information, including the identity and insurance information of the parties involved in the incident. You must also cooperate in any loss investigation conducted by HAPPYRIDE PR, the third-party claims administrators, or insurers. After an incident involving more than minor damage to the vehicle (for example, a small dent or scratch), you may not continue to operate the vehicle unless expressly authorized by HAPPYRIDE PR personnel. Failure to timely report an incident or to cooperate in an investigation may reduce or invalidate any protection plan received through the Services.
Vehicle theft
The following conduct may result in your vehicle being reported stolen to the police, which may expose you and any other driver to arrest, civil and/or criminal penalties, and the revocation of your protection plan:
If you do not return the vehicle you reserved at the time and place agreed upon with HAPPYHOST or HAPPYRIDE PR and/or designated in your reservation, and once the deadlines specified as exempt have been met.
If you fail to return the vehicle at the end of the booking period and have not properly obtained a booking extension through the Services as set out here or agreed to pay for your trip over time and the trip is cut short due to a payment method failure and you fail to return the vehicle
If the vehicle is returned to a location other than the one indicated in the reservation, any damage, loss, or theft of the vehicle that occurs before HAPPYRIDE PR or its affiliates inspect it at the end of the reservation will be the responsibility of the renter.
If you misrepresent any facts relating to the reservation, use, or operation of the vehicle.
If the vehicle's interior components, mandatory safety equipment, or additional service equipment are stolen or damaged, or if the vehicle itself is stolen or damaged when the vehicle is left unlocked or running or unattended with the keys unsecured during the reservation period
If you fail or refuse to contact HAPPYRIDE PR or its affiliates, the police, or other authorities in good faith with a complete report of any accident or vandalism involving the vehicle or fail to cooperate in the investigation of any accident or vandalism
If the vehicle is operated by someone who has provided a fictitious name, a false address, or a false or invalid driver's license, whose driver's license becomes invalid during the reservation period, who has obtained the keys without the permission of HAPPYRIDE PR or its affiliates, or who misrepresents or conceals facts, use, or operation of the vehicle.
The primary renter making the reservation is responsible for any private investigation costs HAPPYRIDE PR deems necessary to recover an unreturned vehicle. Additionally, the primary renter will be charged a $500 administrative fee if HAPPYRIDE PR or its affiliates are required to report a stolen vehicle to authorities due to non-return.
Repossession. HAPPYRIDE PR, an agent contracted by HAPPYRIDE PR, or a HAPPYHOST affiliate may repossess any vehicle reserved through the Services without a request, at the renter's expense, if the vehicle is not returned at the end of the reservation, is illegally parked, appears abandoned, or is being used in violation of applicable law or these Terms.
Lost Vehicles. If a vehicle you have reserved through the Services is lost or stolen during the reservation period (or extension), you must immediately return the key to HAPPYRIDE PR, file a police report immediately upon discovering the loss or theft of the vehicle, but in no event later than 12 hours after discovering its loss, and fully cooperate with the Affiliate, law enforcement, HAPPYRIDE PR, and other authorities in all matters related to the investigation.
FUEL POLICY
The vehicle will be delivered with a full tank and must be returned in the same condition or a $5.00 fee will be charged per missing gallon plus a $15.00 administrative fee.
CLEANING POLICY
A $50.00 fee will be charged if the vehicle is returned in excessively dirty or stained conditions.
VEHICLE CONDITION
The vehicle is returned in optimal mechanical and aesthetic condition, with the indicated fuel level. Any damage must be reported at the time of return. Upon return, the vehicle must be in the same condition and with the same fuel level, or an additional charge will be applied.
ROADSIDE ASSISTANCE SERVICE
HAPPYRIDE PR LLC offers the RENTER an additional Roadside Assistance service for added safety and convenience during the rental period. This service includes, but is not limited to, the following benefits:
Assistance for mechanical breakdowns that prevent the safe circulation of the vehicle.
Tire replacement due to puncture or damage on the road, provided that a spare is available, since HAPPYRIDE PR LLC will deliver the vehicle with a spare tire. If it is missing at the time of the incident, the LESSOR will be responsible for the cost of the required tire.
Low battery assistance.
Opening the vehicle in case of accidental locking with keys inside.
Emergency fuel supply (up to 2 gallons).
Towing of the vehicle to the nearest authorized workshop or destination authorized by the LESSOR, within a maximum radius of 10 miles.
Cost: This service has an additional cost (established according to the current rate at the time of booking) and must be requested and paid for prior to the start of the rental.
Conditions:
This service only applies within the territory of Puerto Rico.
It does not cover damage caused by negligence, improper use of the vehicle, or violation of the clauses of this contract.
In case of towing outside the coverage radius, the LESSEE will be responsible for any additional charges.
The LESSEE must contact exclusively the HAPPYRIDE PR LLC Assistance Center, whose service number will be indicated in the vehicle documentation and on the reservation sheet.
Assistance will depend on operational availability at the time of the request.
Payment Processing. Payment processing services are provided by Stripe and are subject to the Stripe or SQUARE Connected Account Agreement, which includes the Stripe Services Agreement (collectively, the "Stripe Terms"). In countries where you receive payments through Stripe, you agree to be bound by the Stripe Terms, as they may be amended from time to time. You also agree that HAPPYRIDE PR is not liable if Stripe processes a payment late or makes an error related to a payment or payment hold. You acknowledge that HAPPYRIDE PR, Stripe, and SQUARE are independent entities. You are responsible for separately updating information for HAPPYRIDE PR and Stripe when there are material changes to the information you previously provided (e.g., business name, tax information, contact information). You authorize HAPPYRIDE PR to share such information and transaction information with Stripe to facilitate the payment processing services provided by Stripe. HAPPYRIDE PR reserves the right to change payment processing providers at its discretion.
EARLY TERMINATION
THE LANDLORD may terminate the contract immediately if THE TENANT breaches any of its clauses, without the right to a refund of payments already made.
JURISDICTION
Both parties agree to submit to the laws and courts of the Commonwealth of Puerto Rico for any claim related to this contract. Arbitration costs. If you initiate arbitration proceedings, you will be responsible for the costs.
